Warranty & Liability Statement




All Hathorn® Corporation products come with a One Year Limited Warranty against manufacturers defects on all parts and labor.

1. Limited Warranty Coverage.

This Limited Warranty provides one full year of coverage under our manufacturer’s standard new product warranty.  Hathorn® Corporation warrants to the original purchaser of our products that the product shall function as designed for a period of one year from the original date of purchase under normal and proper usage. This one-year Limited Warranty covers malfunctions resulting from defects in materials or workmanship only.  If a Hathorn® product fails to function as designed under normal and proper usage due to defects in materials or workmanship during the period of this Limited Warranty, Hathorn® will repair, adjust or replace defective parts as Hathorn® deems appropriate. 

This Limited Warranty applies only to Hathorn® sewer and gas camera systems that are distributed in the United States, Canada and Australia that are purchased from Hathorn® or an authorized Hathorn® dealer.  The Limited Warranty is not transferable. This Limited Warranty does not apply to Hathorn® branded products imported and/or sold by unauthorized dealers, distributors or other sellers.

In order to handle any warranty claim with a minimum of delay, please follow this procedure:

  1. Return the item to your local wholesaler and have them notify us immediately with complete information on the problem; or visit our website and fill out an electronic RMA form.  Instruction must be followed when returning items to us.

  2. We must have the serial number, the date of purchase, and the name of the wholesaler from whom your machine was purchased.

  3. Ship freight prepaid, and you will be compensated for these charges if it is determined that the part is defective. If repairs are necessary due to conditions beyond our control, or if the item is out of warranty, we will do the work at the lowest possible cost, but a charge will be made.


This one year Limited Warranty does not cover damage or malfunctions stemming from other than normal and proper usage or from products not meeting the requirements of end users. This Limited Warranty also does not cover the following: (a) intentional or accidental misuse or abuse (including, but not limited to, damage to push rod from excessive force), (b) failure to follow operating or maintenance instructions, (c) repairs by any individual or entity other than an authorized Hathorn® repair center, (d) use of product components, accessories or consumables not manufactured by Hathorn® (e) product tampering, (f) droppage, (g) battery leakage if equipped, (h) media cards. (i) excessive light damage to the camera element or (j) damage due to negligence, rust, exposure to corrosive chemicals, accidents, or alteration from original design or damage resulting from being used in extreme environments or due to weather events. Routine cleaning and normal cosmetic wear and tear are not covered by this Limited Warranty.


Hathorn®'s responsibility under this Limited Warranty is limited to the repair, adjustment or replacement of defective parts as determined by Hathorn® Corporation in its sole discretion.  Hathorn® Corporation shall not be held liable for any damages, including but not limited to direct, indirect, special, or consequential damages arising out of, resulting from, or in any way connected to the use of Hathorn products. Hathorn® assumes no responsibility for other’s use or misuse of its products.

Hathorn® Corporation assumes no responsibility for warranties either expressed or implied beyond that which is contained herein.



By purchasing a Hathorn® Corporation product, you accept the terms of this limited warranty. You also agree that Hathorn® Corporation shall have no liability to you or any end user for any damages resulting from delay or loss of use of the product due to failure of the product within the warranty period, or otherwise, or in service or repair. 

Hathorn® shall have no liability for general, special, incidental or consequential damages arising out of, resulting from, or in any way connected with use or misuse of Hathorn® products.

You also agree that the application and use of a Hathorn® Corporation product is beyond our control and is the sole responsibility of the user. By receiving and using one of Hathorn's products, you hereby acknowledge and agree that:

  1. ​You have selected the correct product for your intended use and will examine the product you are purchasing when it arrives to ensure that it meets your needs.

  2. You will properly test the product prior to its actual use.

  3. You and/or your organization has proper practices in place for the safe use of this equipment and that end users have been trained on its safe operation.

  4. Hathorn products are not intrinsically safe, not explosion proof and misuse of the product may cause physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability, economic or emotional loss and death.

  5. Hathorn® Corporation shall not be held liable for any damages, including but not limited to direct, indirect, special or consequential damages arising out of, resulting from, or in any way connected to the improper or incorrect use of the product and assumes no responsibility for other's use of the product.


3. Obtaining Service.

Should you wish to return the item to Hathorn® in Canada or the USA please contact us on 1-866-HATHORN to secure an RMA.  Once secured pack the product carefully using ample packing material in order to prevent damage during shipment and mail it postage prepaid and insured to one of:


  • Hathorn® Corporation 255 Shields Court, Unit C Markham, Ontario, Canada, L3R 8V2 (Dock #2)

  • Hathorn® USA 739 North Wilson Road, Columbus, OH, 43204 USA


The Product can also be shipped to the dealer from where it was purchased. When service is completed, your product will be returned to you postage prepaid or collect.  Hathorn® Corporation is not responsible for damages or loss incurred in connection with mailing and/or transportation of product.  We recommend that clients opt to insure their package with our preferred carrier UPS. 


In your package, please include the following:


  • A copy of the sales receipt showing the date and place of purchase.

  • All accessory items that may be related to the problem.

  • A detailed description of the problem.

4. Refunds.

Products purchased directly from Hathorn® Corporation may be returned for a refund within 30 days of purchase provided that the product has not been used and is in as new condition appropriate for resale.  A 15% re-stocking fee shall apply.

Under no circumstances shall refunds be offered for items returned for warranty repairs.  All warranty repairs shall be honored in line with our warranty policy above.


By the Customer issuing Hathorn Corporation a purchase order (an “Order”) and by Hathorn accepting an Order both parties accept all the terms and conditions hereof.


Price: Unless otherwise specified, the price on an Order represents the pre-tax cost to the Customer as at the point of delivery specified herein. Any local, municipal, state or federal taxes or fees are to be borne by the Customer and are not included in the cost outlined.


Changes of Order: The  Customer may make  changes  to  an order  prior to shipment.  Hathorn shall notify the Customer of the changes in the cost of the order.


Inspection and Rejection: The goods and services are subject to inspection and test by Customer.  If the goods and services are found not in accordance with all the details shown on an Order, the Customer must notify the Hathorn within 10 business days. 


Compliance with Laws: By the acceptance of an Order, Hathorn and Customer represent that they have and will continue during the performance of this order to comply with the provisions of all federal, provincial and local laws and regulations from which liability may accrue from any violation thereof.



Intellectual Property: Intellectual property rights include any right that is or may be granted or recognized under any Canadian or foreign legislation or other legal theory (including at common law, civil law or in equity) regarding patents, inventions, copyrights, moral rights, trademarks, industrial designs, trade secrets, know-how, integrated circuit topography, whether registered or unregistered, and including rights in any application, registration, renewal or extension for any of the foregoing. Any intellectual property (which includes anything which is or may be protected by any intellectual property right) developed, and all materials, deliverables and other work product created by Hathorn or its personnel, in the course of providing the goods or services under the Order, and all intellectual property rights therein, shall be owned by Hathorn unless stipulated otherwise in the Order or otherwise agreed to in writing. Customer agrees not to retain, disclose to any third party, or use any such intellectual property owned by Hathorn without prior written permission.


Payment Terms and Invoice: The calculation of the payment period in accordance with the Payment Terms shown on the Order shall commence upon all of the following conditions being satisfied upon the delivery of the goods or services supplied under the Order.


Termination: Hathorn may, at its sole option, terminate this order in whole or in part, without penalty or compensation upon written notice served to the Customer. Customer will pay the Hathorn for the goods and services satisfactorily provided and accepted by the Customer to the effective date of termination. The termination of this order shall discharge any further obligations of either party.


Indemnification: Except  for  damages  caused  by  the  negligence of Hathorn, Customer shall defend,  indemnify and  hold Hathorn harmless from all claims, actions, demands, loss and cases of action arising from injury, including death, to any person, or damage to any property, when such injury or damage results in whole or in part from the acts or omissions of Hathorn and from any use or mis-use of the supplied equipment or service.


Dispute Resolution: Customer agrees to meet, negotiate, and attempt to resolve, in good faith, amicably, without litigation, any disagreement, question or difference of opinion with the Hathorn as to the interpretation, application, or administration of this Order, including any Invoice (a “Dispute”).  If the two Parties cannot resolve any such Dispute within thirty (30) business days, or such a period as the Parties may subsequently agree, then it shall be submitted to their respective senior representatives with authority to bind the party to meet to resolve the Dispute.   If the Parties are still unable to resolve the dispute through negotiations within thirty (30) business days, or such a period as the Parties may subsequently agree, the parties agree to attempt to resolve the Dispute through mediation by submitting the Dispute to a sole mediator selected jointly by the parties. The Parties agree to participate in good faith in the mediation following appointment of the mediator for such a period as the Parties may agree. Finally, the Dispute shall be resolved by arbitration or litigation, as agreed by the Parties.
